Trumps Impeachment Trial Offers a Chance to Seize the Initiative on the Future of Free Speech – The New Yorker

When Donald Trumps second impeachment trial opens this week, the prosecution and defense will spend much time debating whether it is unconstitutional to try a President no longer in officea dodge Republicans have seized upon to avoid taking responsibility for Trumps actions on January 6th and to avoid his wrath. With conviction now unlikely, the trial offers Democratic senators and the handful of open Trump skeptics among the Republicans a chance to engrave Trumps assault on the Constitution into the historical record. But the trial will also be a forward-looking political foruma preview of how January 6th will figure in electoral competition between Democrats and Republicans, and among Republicans, in the months ahead.

Trumps lawyers and acolytes have already made plain some of the political ground they prefer to fight on: the defense of the First Amendment. Impeaching Trump for mobilizing the January protesters with false claims about election rigging is a very, very dangerous road to take with respect to the First Amendment, putting at risk any passionate political speaker, one of Trumps impeachment lawyers, David Schoen, told Sean Hannity on Fox News last week. The initial fourteen-page brief that Schoen and his co-counsel Bruce Castor filed in Trumps defense mentions the First Amendment five times, aligning its arguments with the cancel culture protestations so prominent in conservative discourse: If the First Amendment protected only speech the government deemed popular in current American culture, it would be no protection at all.

As a defense against the Houses impeachment charge, however, the legal protections afforded by the First Amendment are largely irrelevant. The Constitution has designed impeachment as a political process, not a judicial one; what the House charges and what the Senate decides cannot be appealed to federal courts, for example, and the antiquated standard of high crimes and misdemeanors has been left to dangle for more than two centuries without clear definition. In criminal law, Trumps incendiary speech on January 6th, at the rally that preceded the assault on the Capitol, raises the question of whether his words are prohibited by the very narrow incitement exception under the First Amendment; free-speech scholars disagree about whether he crossed the legal line. But, at the impeachment trial, it doesntor shouldntmatter, since the First Amendment does not shrink the scope of the impeachment power or alter what conduct warrants a Senate conviction, as the House impeachment managers wrote in their trial memorandum, quoting Keith E. Whittington, a Princeton politics scholar.

There is no doubt that Trumps abuse of officehis lies about election fraud, his strong-arming of state election officials including Georgias Secretary of State Brad Raffensperger, his advocacy for unconstitutional interventions in the Electoral College, and, finally, his incitement of protesters to march on the Capitolwarrant impeachment and conviction. The House prosecution brief prominently quotes Republican Representative Liz Cheneys emphatic judgment: There has never been a greater betrayal by a President of the United States of his office and his oath to the Constitution.

Yet, when addressing Trumps prospective First Amendment defense, the prosecutors become more lawyerly and less persuasive. The House brief argues that rights of speech and political participation mean little if the President can provoke lawless action if he loses at the polls. It goes on to say that, because Trump attempted to subvert the Constitution by trying to overturn an election, he carried out a direct assault on First Amendment rights, and so his conviction by the Senate would vindicate First Amendment freedoms. This is a stretch; in any event, it would seem better and more consistent with liberal tradition to couple condemnation of Trumps incitement on January 6th with a confident argument to preserve robust free speech in the public squareas an antidote to Trumpism, among other things.

The briefs weakness on the First Amendment issue signals a loss of clarity among Democrats and liberals about the unqualified defense of free speech. Partly, this is because the serious emergency that Trump created after losing in November is proving difficult to enclose. Will Trump really be banned from all major social-media platforms forever? On what ground, and on whose authority? What will be the consequences of corporate deplatforming policies for civil-rights activists on the leftor for quirky, offensive speakers on the cultures fringes?

There can be little doubt that policies which suppress Trumpian voices will eventually be used to suppress other voices. Even before the 2020 election, DeRay Mckesson, a Black Lives Matter activist who helped organize protests against the police killing of Alton Sterling, in Louisiana, had been taken to court by a police officer who claimed that he was responsible for injuries the officer allegedly sustained in a rock-throwing incident, even though Mckesson had not been involved in any violence himself. (The Supreme Court returned the case to local courts, without ruling on the First Amendment issues.) It is not hard to imagine how red-state and Trump-aligned prosecutors may use the fallout from January 6th to go after civil-rights campaigners whose protests organized on social media turn violent, even if the violence is carried out by saboteurs or by fringe extremists.

President Biden and Democrats in Congress are preparing an aggressive regulatory and antitrust agenda aimed at social-media and other tech companies, recognizing the democratic distortions created by their power. But the record of Democrats in this arena is poor. Over a decade or more, their light touch on antitrust and public-interest regulation enabled the growth of the social-media giants that now dominate our public square. Until now, Democrats have effectively lashed themselves to the corporate-free-speech policies of publicly traded corporations that face pressure to maximize shareholder valueand not necessarily the public interest. The voluntary actions taken by Facebook, Twitter, Google, Amazon, and other companies against Trump and his insurrectionist allies this winter did help contain a constitutional crisis. But the evolution of these corporate policies into a next-generation, privatized free-speech regime that will shape elections in 2022 and 2024 should make every citizen queasy, given what we have seen on the largest platforms since 2016.

Twitter has announced a permanent ban on Trumps world-bending @realDonaldTrump account, on the ground that allowing Trump to tweet risked inciting further violence, which runs afoul of Twitters 2019 World Leaders policies, whose very existence signals the nature of the platforms ambition and influence. Facebook, for its part, seeks to evolve its emergency interventions into sustainable corporate policies and has turned to its nascent Oversight Board for assistance. The board was created last year to promote free expression by making principled, independent decisions regarding content on Facebook and Instagram and by issuing recommendations on the relevant Facebook company content policy. Last month, Facebook asked the board to decide whether to reinstate Trumps access to the platform. This decision has great consequences for similar situations that may arise in the future elsewhere, Nick Clegg, Facebooks vice-president for global affairs and communications, told National Public Radio.

The Oversight Board is made up of twenty scholars, activists, and journalists from more than a dozen countries, and includes such respected figures as Alan Rusbridger, the former editor of the Guardian, who bravely published Edward Snowdens revelations, under intense pressure from the British government not to do so. Yet the membership list can read like a parody of the conspiracist black-helicopter crowds anxieties about unaccountable global governance. Whatever the board decides about Trump, its own legitimacy may attract as much scrutiny as its recommendations do.

Facebook and Twitter have long sought to occupy a position of neutral permissiveness toward speech, inspired by First Amendment principles. Yet their business models have also led them to surveillance and data-mining practices that are incongruent with civil liberties. Last week, Charlie Warzel and Stuart A. Thompson of the Times reported on a data set that they obtained from sources that tracks the movements of some hundred and thirty individuals who were inside the Capitol on January 6th. It isnt clear who collected this surreptitious information, as Warzel and Thompson called it. Phone and social-media companies are among those that could have had access. (The data showed where smartphones and so, potentially, their owners, were, inside the building.) Warzel and Thompson called the data set a demonstration of the looming threat to our liberties posed by a surveillance economy that monetizes the movements of the righteous and the wicked alike.

Trump will be tried this week for his incitement of insurrection against the Republic he swore to protect, as the House trial memorandum begins. In periods of national division and anxiety, such as this one, as the First Amendment scholar Geoffrey R. Stone narrates in his essential book Perilous Times, Americans have repeatedly overreacted and suppressed dissent in ways that, in hindsight, seem hysterical or malign. There is certainly no reason to shrink from Trumps impeachment or conviction on free-speech grounds, as the board of the American Civil Liberties Union has persuasively argued. After the trial, however, a path to politics and public policy that neither enables Trumpian assaults on voting and the Constitution nor undermines the radical American experiment in free speech will be very hard to find. It is necessary nonetheless.

US cities may be underestimating their emissions – Cities Today

A new study finds that US cities could be underestimating their greenhouse gas emissions by an average of 18.3 percent and in some cases by up to 145 percent.

The researchers put the discrepancies largely down to inconsistencies in the way cities calculate emissions.

The study, published inNature Communications, compared the self-reported emissions inventories of 48 major US cities to estimates from a detailed emissions information system developed by researchers at Northern Arizona University. It found large differences and a systematic under-reporting of urban emissions by cities.

The cities in the study included New York, Chicago, Los Angeles, Dallas, Denver and Philadelphia.

The results of this comparison were surprising, said Professor Kevin Gurney of Northern Arizona Universitys School of Informatics, Computing, and Cyber Systems, who led the research. The differences were large and varied widely from one city to the next. When averaged, the self-reported emissions were almost 20 percent below the emissions estimated by the Vulcan system.

He added that the average doesnt tell the whole story, noting that Cleveland, Ohio reported emissions 90.1 percent below the Vulcan estimate while Palo Alto, California reported emissions 41.7 percent greater than the researchers system.

The adage you cant manage what you cant measure is really applicable here, Gurney said. Cities need a comprehensive and accurate assessment of their emissions. Without it, they could target the wrong emissions sources in their landscape for emission reduction or think they are on an emissions trajectory to meet their target, when in fact, they are not.

He added that this accuracy is also crucial to getting and keeping citizens on board with climate action.

Cities typically estimate their GHG emissions using tools such as the Global Protocol for Community-Scale Greenhouse Gas Emissions Inventories (GPC), developed by the World Resources Institute, C40 Cities Climate Leadership Group and ICLEI Local Governments for Sustainability, and the Global Covenant of Mayors Common Reporting Framework.

The process remains complex, though, and methodologies still differ. The report highlights key areas of variance such as accounting for shipping and airborne emissions and on-road emissions, for instance.

Further, cities may miss or exclude certain categories due to data challenges or resource constraints.

The Vulcan tool, which Gurney and a team of science and climate specialists, have developed over 15 years offers a standardised system for quantifying greenhouse gas emissions. It was funded by the National Aeronautics and Space Administration (NASA) and the National Institute of Standards and Technology (NIST), and quantifies and visualises greenhouse gases emitted across the entire country down to individual power plants, neighbourhoods and roadways.

In an interview with Cities Today, Gurney described it as a big data mining machine. It uses around 30 different datasets related to CO2 emissions, including federal databases, regulatory data, Highway Administration data, energy statistics and fuel consumption figures, as well as information on land parcels, buildings, traffic and demographics.

It really is a giant mixture of different datasets that we bring together and then we try to place the emissions as best we can in space and time across the whole landscape, Gurney said.

The results from Vulcan are compared to atmospheric measurements to confirm accuracy.

Gurney says the system can also help cities better prioritise and target their climate actions down to the specific pieces of roadway or buildings that are creating the most emissions. In one city, for instance, the tool shows that around 10 percent of the physical road surface accounts for 60 percent of on-road CO2 emissions. With this insight, cities could achieve results faster and at lower cost.

Gurney is pushing for federal agencies in the US and global organisations more widely to consider adopting Vulcan as a systematic way to track emissions.

He uses the analogy of the weather: In the same way that we wouldnt expect every city or state to collect weather data, run a weather model and figure out their own weather, it doesnt seem very efficient to have every single city engaging in this redundant activity, which is costly, tedious and very time-consuming. We have a centralised system that weve built much like a weather forecast system, and we can make this foundational data available to everybody.

Laura Jay, C40s Regional Director for North America, told Cities Today: The report underscores how critical cities are to addressing the climate crisis. It also makes an important case for a strong partnership between the federal government, states and cities with a focus on which specific emissions each level of government can most effectively address, as well as cities working closely with the business community to bring down emissions from all sectors.

The next steps for Gurney and his team are looking at scope 3 emissions in the value chain, as well as globalising the research using remote sensing.

Who is Andy Jassy? Amazons new CEO ushered in the era of cloud computing – The Guardian

Amazon on Tuesday said its billionaire founder, Jeff Bezos, would step down as chief executive officer and become executive chairman after nearly 30 years at the company.

The transition will promote the companys current cloud computing head, Andy Jassy, to the next chief executive of the company, as Bezos hands over the reins for the first time since he founded Amazon and oversaw its evolution from small online bookstore to ubiquitous retail juggernaut.

Jassy, 52, joined Amazon in 1997 after Harvard Business School. I took my last final exam at HBS, the first Friday of May in 1997, and I started Amazon next Monday, Jassy said in a Harvard Business School podcast in September. No, I didnt know what my job was going to be, or what my title was going to be.

Jassy went on to found Amazon Web Services, according to the companys website, a cloud hosting product that creates the infrastructure used by millions of companies, schools, and governments to run websites and apps.

In the years since, AWS has grown into a cloud platform used by millions that dominates legacy players like Oracle and Microsoft.

The company now owns almost half the worlds public cloud infrastructure market. It boasts a dominant 30% market share of the cloud computing market.

Competitors are eyeing Amazons top spot, however, with Microsoft and Google announcing growth in their cloud computing businesses in the fourth quarter.

His promotion underscored the importance of web services to Amazons future, said Tom Johnson, chief transformation officer at Mindshare Worldwide.

Jassys background in steering AWS shows just how top-of-mind those services are to Amazons business strategy, Johnson said. It will be interesting to see how that affects their strategy and balancing that priority with a growing ad business and the commerce behemoth.

Bezos said in a letter to staff on Tuesday that he had full confidence in Jassy. Andy is well known inside the company and has been at Amazon almost as long as I have, he said. He will be an outstanding leader.

Bezos added that he would stay engaged in Amazon initiatives. But I will also have the time and energy I need to focus on the Day 1 Fund, the Bezos Earth Fund, Blue Origin, the Washington Post, and my other passions, he wrote. Ive never had more energy, and this isnt about retiring. Im super passionate about the impact I think these organizations can have.

Jassy is known for understanding technical details, and has bestowed a rock-star aura to keynotes at AWSs annual Las Vegas conference. He has occasionally spoken out on social issues, tweeting about the need for police accountability after Breonna Taylor, a Black woman, was killed in her home by white policemen during a botched raid, and in favor of LGBTQ+ rights.

Amazon said it was not announcing an AWS replacement for Jassy yet.

KEYSER - As we reach the year mark of the COVID-19 pandemic, many people have been staying in place at their homes for quite some time.

Many are working from home, and have severely limited their travel time.

Now more than ever it is important to take care of ourselves and our health. For most, when they hear health, they think only of physical health. Yet mental heath is also very important. Experts suggest that our mental health and physical health are closely related, with one affecting the other.

Yet how do we care for our mental health? It is not like we can put our mind on a treadmill, although it may feel at times that its on one.

Caring for your mental health can be easy in many ways. Some people find themselves stressed or experience high levels of anxiety during this time of year. All you hear on social media or the news is pandemic talk and turmoil amid elections. Take this opportunity to unplug, as you will, from the stressors. Turn off the television, log out of social media sites. Its hard to not let the stress get to you if that is all youre seeing. Too much exposure to the negative is never a good thing, so take a break.

Negative energy tends to attract negative energy. So try and focus on the positives that you see. Although we may find this hard at times, there is always something to be grateful for. A positive mindset is half the battle won.

Make sure to set some time aside to take care of yourself daily. You can meditate, do some deep breathing, or do a facial; as long as you carve out time to make yourself a priority to do things you enjoy.

Some people tend to have a harder time to focus on themselves. Many find that the stress or anxiety is overwhelming. It is harder for the mind to come out of those feelings. There are several coping techniques that you can try to help combat these issues.

Doing controlled breathing exercises is one of the many ways for you to focus and relax the mind and body. Your breath affects your whole body. Breathing exercises are a good way to relax, reduce tension, and relieve stress. Breathing exercises are easy to learn and use. You can do them whenever you want, and you don't need any special tools or equipment to do them.

According to Michigan Medicine, one simple exercise is belly breathing.

Belly breathing

Belly breathing is easy to do and very relaxing. Try this basic exercise anytime you need to relax or relieve stress.

1. Sit or lie flat in a comfortable position.

2. Put one hand on your belly just below your ribs and the other hand on your chest.

3. Take a deep breath in through your nose, and let your belly push your hand out. Your chest should not move.

4. Breathe out through pursed lips as if you were whistling. Feel the hand on your belly go in, and use it to push all the air out.

5. Do this breathing 3 to 10 times. Take your time with each breath.

6. Notice how you feel at the end of the exercise.

With anxiety being at an all-time high for many people right now, deep breathing is a great way to to fight it. Most people take short shallow breaths into their lungs. This quick short breathing is a breeding ground for anxiety and panic attacks. Taking deeper breaths into you lungs is a great way to help you relieve some of your anxiety. Taking a deep breath of air into your lungs and exhaling slowly helps to slow the mind and relax the body.

There are several breathing techniques you can try and examples are available online.

Meditation is another way to help relieve stress and anxiety. Meditation is also easy to do and requires no special equipment. Its an easy to do, even if you have never done it before. To start learning meditation all you have to do is begin with a quiet place.

Sit or lie comfortably, if you sit you can use a pillow to cushion you on the floor. Close your eyes, and breathe naturally. Push all thoughts from your mind, and simply focus on the breaths that you take. If a thought enters your mind, simply push it out. Sit there till you can begin to feel your body relax. There is no set time amount to do. Just simply continue until you feel yourself in control and relaxed.

You can try several different types of meditation and can find guides to help you on many medical sites online.

There are many different coping techniques available and the key is to find the best one for you that works. Some are simple little things that you can do to try and keep your self in a healthy place. Making time for yourself, doing physical exercise, spending time with friends by phone or video chat, laughing as much as possible, reading, or simply doing things you enjoy.

Your mental health is very important and should not be overlooked. Taking care of yourself is not simply about body, but also the soul.

Make sure to do all you can to keep your mental health on the right track during the pandemic, and keep these ideas with you for life for a more relaxed and stress free mind.
